Terms and Conditions of Sale (TCS) - Kaporal

These general terms and conditions of sale apply as of right to all product sales concluded between:

- The company DISTRIBRANDS CORP, a simplified joint-stock company with a capital of €26,000, registered with the LYON Trade and Companies Register under number 842.080.046, with its registered office at 92 Rue Louis Becker, 69100 Villeurbanne, France — hereinafter referred to as "the Seller".

- Individuals wishing to make a purchase on the website https://kaporal.fr — hereinafter referred to as "the Customer".

ARTICLE 1 - ACCEPTANCE

By placing an order, the Customer accepts these GTC. The Seller may modify them at any time on https://kaporal.fr.

ARTICLE 2 - PRE-CONTRACTUAL INFORMATION

The Customer acknowledges having been informed of the essential characteristics of the Products, the price, delivery times, the right of withdrawal, and legal guarantees.

ARTICLE 3 - PRODUCTS

The products sold are those listed on the Site on the day of consultation. Offers are valid only within the limits of available stock.

ARTICLE 4 - ORDER

The Customer selects the products, validates their cart, logs in or creates an account, then confirms their order with payment. The Seller reserves the right to refuse any order in case of dispute or prior non-payment.

ARTICLE 5 – PRICE

Prices are expressed in Euros, including all taxes, excluding shipping costs. The Seller reserves the right to modify them at any time.

ARTICLE 6 – PAYMENT

Payment is made by credit card. Transactions are secured by SSL encryption.

ARTICLE 7 – DELIVERY

Delivery is made to the address indicated by the Customer. Delivery is free for purchases over €120 for orders destined for the European Union, excluding promotional operations.

ARTICLE 8 – RIGHT OF WITHDRAWAL

The Customer has 14 days from receipt to withdraw. Products must be returned unworn, unwashed, with an invoice. Only one return request per order is accepted.

In case of a refund (excluding product defects), variable return fees depending on the country will be deducted. In case of a credit note (valid for 1 year), return fees are free, and a bonus of €10 is added.

ARTICLE 9 – GUARANTEES

Products benefit from the legal guarantee of conformity (Articles L.217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code).

ARTICLE 10 – RETENTION OF TITLE

The transfer of ownership of the products will only take place after full payment of the price.

ARTICLE 11 – FORCE MAJEURE

Neither party shall be held liable in the event of force majeure.

ARTICLE 13 – PERSONAL DATA

The Customer's personal data is processed in accordance with the privacy policy available on the Site.

ARTICLE 14 – INTELLECTUAL PROPERTY

All content on the https://kaporal.fr website is the exclusive property of the Seller. Kaporal is a registered trademark. Any reproduction is strictly prohibited.

ARTICLE 15 – GENERAL PROVISIONS

These GTC are subject to French law. In case of dispute, the Seller adheres to the AME CONSO mediation service — www.mediationconso-ame.com — 11 Place Dauphine, 75001 PARIS.

ARTICLE 16 – PROMOTIONAL CODES

Promotional codes are valid once per Customer, cannot be combined, and are not valid during sales, Black Friday, and other special promotional periods.
